SALMA BEGUM Vs. BARASAT MUNICIPALITY

JUDGEMENT

(1.) The writ petitioner has approached this Court, not for infringement of any rights of the public but for infringement of her private right.

(2.) At all material times upto 31st March, 2015, the petitioner was enlisted with the Barasat Municipality to carry on the trade of carpentry and wooden furniture. She says that her business is a secondary unit under Sec. 4C II (iii) of the West Bengal Forest (Establishment and Regulation of Saw Mills and Other Wood Based Industries) Rules, 1982.

(3.) Her grievance is that this enlistment has not been renewed by the Municipality, The principal objector to the renewal of the petitioner's licence is the private respondent, the respondent No. 5 who is said to run a doctor's clinic on a plot of land which is very near to her place of business.
