JUDGEMENT

(1.) In this application under Section 24 of the Code of Civil Procedure, 1908 the petitioner -wife has prayed for, transfer of the matrimonial suit filed by the opposite party -husband and pending before the Court of the learned Judge, 2nd Fast Track Court at Barasat, North 24 -Parganas to the Court of the learned District Judge, Paschim Medinipur.

(2.) A copy of this application was forward to the opposite party at his address mentioned in the cause title of the plaint filed by himself in the matrimonial suit, but the postal department has returned the envelope containing the copy of this application with an endorsement "not known". The petitioner also forwarded a copy of this application to the opposite party at his present place of employment at Palla Block Primary Health Center, P.S. -Gopalnagar, District -North 24 -Parganas and the opposite party has received the same. Let, affidavits of service filed by the petitioner together with the copy of the envelope containing the copy of this application be kept with the record.

(3.) In spite of receipt of a copy of this application, none appears for the opposite party to oppose this application, Thus, this application is taken up for hearing in the absence of the opposite party.
