(1.) Appellant Bimala Devi Khetwat, Kamini Dey @ Nilu, Khokan Giri @ Madhab and Jagadish Jadav @ Basuki stood for trial before the learned Additional Sessions Judge, 6th Court, Alipore in the district of 24-Parganas (South) in connection with Sessions Trial No. 18 (12) of 1992 and all the four persons faced charge under Sec. 302/120B of the I.P.C. jointly and, that apart, Kamini Dey, Khokan Giri and Jagadish Jadav faced charges under Sec. 302/34 of the I.P.C. and also under Sec. 394 of the I.P.C.

The learned Additional Sessions Judge, after conclusion of trial on 29th Jan., 1999 holding Bimala Khetwat, Kamini Dey, Khokan Giri and Jagadsih Jadav guilty under Sec. 302/120B of the I.P.C., convicted them accordingly and the learned Judge also holding Kamini, Khokan and Jagadish guilty of the offences under Sec. 302/34 and under Sec. 394 of the I.P.C. convicted them and on 30th Jan., 1999 after hearing the convicts, the learned Judge sentenced Bimala Devi Khetwat to suffer rigorous imprisonment for life along with other three convicts under Sec. 302/120B of the I.P.C. and Kamini, Khokan and Jagadish were also sentenced to suffer imprisonment for life under Sec. 302/34 of the I.P.C. and they were also sentenced to suffer rigorous imprisonment for ten years each and to pay a fine of Rs. 10,000.00 each in default to suffer rigorous imprisonment for six months each for the offence under Sec. 394 of the I.P.C.
(3.) Being aggrieved by and dissatisfied with the order of conviction and sentence, Bimala Khetwat preferred Criminal Appeal No. 41 of 1999, Kamini Dey preferred Criminal Appeal No. 84 of 1999 while Khokan Giri and Jagadish Jadav preferred Criminal Appeal No. 100 of 1999.
