JUDGEMENT

(1.) The petitioner along with eight other members from different member societies were elected as Director of the West Bengal Co-operative Spinning Mills Ltd. in the 16th Annual General Meeting held on 4th October, 2002 under the supervision of one Co-operative Development Officer attached to the Handloom and Textiles Directorate as Election Officer.

(2.) The first meeting of the Board of Directors was scheduled to be held on 1st November, 2002 on the following agenda: "1]. Election of Vice-Chairman 2]. Panel of Chairman."

(3.) Before holding the said meeting, the Deputy Secretary to the Government of West Bengal, in exercise of the power conferred under section 32(2) of the West Bengal Co-operative Societies Act, 1983 and also in terms of the direction of the Governor, issued a Notification on 31st October, 2002 whereby the Annual General Meeting of the Society held on 4th October, 2002, was rescinded and the proposal for notifying the names of the Government nominees in the Board of Directors of the said Society was dropped.
