JUDGEMENT

(1.) No one has appeared on behalf of the opposite party.

(2.) This application is directed against an order dated 9th of November, 2005 whereby the learned Court had allowed the opposite party to file the written statement. Under normal circumstances such order is not interfered with but the facts are rather compelling.

(3.) The suit was filed by the petitioner on 11th of June, 2001 and on the same date an application for injunction was filed and an ad-interim order of injunction was also passed. The opposite party being the defendant received copy of the injunction order along with copy of the application of injunction on 19th of June, 2001.
