SOMNATH SIL Vs. BANK OF INDIA AND OTHERS

JUDGEMENT

(1.) The material facts in the present application are, inter alia, that in March 1966 Somnath Sil, the petitioner, was employed as the Cashier in the Shyambazar branch of the Bank of India, the respondent No. 1.

(2.) There was an audit of the said branch of the Bank on the 3rd Aug. 1968 when a shortage of Rs. 2,400.00 in the cash was detected. The petitioner made up the said shortage by paying the said sum.

(3.) Thereafter on the 6th, the 24th and the 26th Aug., 1968 the petitioner gave several statements in writing to the respondent Bank, according inter alia, that he was personally responsible for the shortage.
