JUDGEMENT

(1.) Petitioner first participated in 12th Regional Level Selection Test, 2011 but was not selected for being appointed in the post of Assistant Teacher which prompted the petitioner to approach a Co-ordinate Bench in connection with a writ petition being WPA 8198 of 2013 (Animesh Roy vs. State of West Bengal & Ors.). Said writ petition was disposed of by the Co-ordinate Bench on 29/7/2022 thereby directing appointment of expert committee for scrutinizing answer keys relating to Teacher Eligibility Test (TET), 2011 by the Head of the Department, Education Department, Jadavpur University. It was also directed in the order dtd. 29/7/2022 that in appropriate cases West Bengal Central School Service Commission (for short, 'Commission') shall award marks to the candidates and consequential benefits shall follow.

Petitioner derived benefit from this order dtd. 29/7/2022 passed by the Co-ordinate Bench by enhancement of marks resulting in issuance of memo dtd. 13/10/2022 by the Secretary of the Commission whereby petitioner was asked to participate in the personality test which was scheduled on 9/11/2022 in connection with 12th RLST, 2011.

(3.) However, petitioner did not participate in the personality test as she was selected in 1st State Level Selection Test, 2016 for classes XI-XII and already obtained job of Assistant Teacher in higher secondary Sec. .
