UBS SWITZERLAND AG Vs. SOFTEL OVERSEAS PRIVATE LIMITED

JUDGEMENT

(1.) The defendants have filed an application being G.A. No. 2 of 2023 praying for rejection of plaint and dismissal of suit on the ground that the suit filed by the plaintiff is barred by limitation.

(2.) The plaintiff has filed an application being G.A. (Com) No. 4 of 2024 to amend the plaint filed in C.S. (Com) No. 518 of 2024.

(3.) Mr. Chayan Gupta, Learned Advocate representing the defendant nos. 1 to 3 submits that the plaintiff's cause of action is ex-facie barred by limitation. He submits that by a letter dtd. 14/3/2018, the plaintiff has demanded his claim from the defendant no.1 which is the subject matter of the present suit.
