JUDGEMENT

(1.) THE instant writ petition is directed against the order dated 20th July, 2013 passed by Learned Civil Judge, Junior Division, Second Court at Sealdah, District 24 Parganas (South) in Misc. Case No. 21 of 2005 arising out of Title Execution Case No. 12 of 2001.

(2.) THE facts leading to this application is that Ratanlal Dawn, since deceased, father of petitioner instituted Title Suit No. 245 of 1998, praying for eviction of the petitioner from the suit property.

(3.) THE suit was contested by the petitioner as a defendant stating, inter alia, that from birth of the petitioner, she has been residing in the suit premises and carried out some kind of construction in the suit premises by investing Rs. 50,000/ and that the petitioner was given possession in the suit property as she was facing great difficulty to stay at her matrimonial house and since the plaintiff was in need of accommodation, petitioner was requested to vacate the suit premises.
