(1.) This application has been filed by the petitioner Manoj Kumar Das under Section 482 read with Section 407 of the Code of Criminal Procedure, 1973. This criminal revisional application has been filed on 5.12.2014 alongwith a separate application being C.R.A.N. No. 4364 of 2014 with a prayer for condonation of delay of 51 days.

In the criminal revisional application petitioner has challenged an order dated 14.7.2014 passed by learned Additional District and Sessions Judge, Fast Track, 1st Court, Contai in Sessions Case No. 147/May/2012. Petitioner has prayed for transfer of that sessions case to the Court of learned Additional Chief Judicial Magistrate, Contai.
(3.) Before taking into consideration the merits of criminal revisional application this Court is of the view that the C.R.A.N. No. 4364 relating to condonation of delay in filing the C.R.R. No. 3687 of 2014 is required to be disposed of. In C.R.A.N. No. 4364 of 2014 application it has been alleged that the petitioner has challenged the impugned order dated 14.7.2014 the application for certified copy was made on 25.7.2014. The certified copy was obtained on 28.7.2014 but due to financial stringency petitioner could not meet his engaged lawyer of High Court within the stipulated period of limitation of 90 days and so beyond that period the instant case has been filed in this Hon'ble Court causing delay of 51 days. On calculation it appears that if as per prayer of petitioner, delay of 51 days be condoned then also the revisional application shall stand barred by limitation by 18 days. As such, I am not satisfied to allow the C.R.A.N. No. 4364 of 2014 for condonation of delay and extension of limitation. Therefore, the C.R.A.N. 4364 of 2014 stands dismissed and disposed of.
