JUDGEMENT

(1.) AFTER hearing Mr. Chatterjee, learned advocate, appearing for the appellant and after considering the materials on record, including the impugned order, we admit this appeal for hearing under the provision of Order 41 Rule 11 of the Code of Civil Procedure. Lower court records need not be called for.

(2.) THE plaintiff/respondent no. 1 is represented by Mr. Sharma, learned advocate, who is assisted by Mr. Debabrata Sen, learned advocate. Thus, the service of notice of appeal upon the plaintiff/respondent no. 1 is dispensed with.

(3.) THE appeal is, thus, treated as ready as regards service upon the plaintiff/respondent no. 1.
