JUDGEMENT

(1.) The accused appellant Alambari owned a piece of land that he was reluctant to give to his sons. Sons were staying separately by constructing their own houses on the land belonging to the appellant. However, there was one single toilet that was being used by all.

(2.) On the fateful day, the daughter-in-law of the appellant, the victim took her bath in the said toilet and immediately thereafter, the appellant protested for using of the said toilet on the ground, it was constructed by him and the victim used it without his permission. There was a scuffle. Ultimately, the appellant over-powered the victim and stabbed her ten times as we find from the autopsy report. There were three eye witnesses -two sons of the victim, who are also the grandsons of the appellant and other one is another daughter-in-law of the appellant.

(3.) The PW-1, the other daughter-in-law vividly narrated the incident that was duly corroborated by two sons of the victim, being the PW-5 and PW-6
