JUDGEMENT

(1.) The appeal is directed against the judgment and order of conviction and sentence dated 27th February, 2008 passed by the Additional Sessions Judge, Fast Track Court III Krishnanagar, Nadia in Sessions Trial No. VI (Jan) 2006 arising out of Sessions Case No. 88 (5) of 2005. By the impugned judgment and order the accused/appellant has been convicted for an offence punishable under Section 302 of the Indian Penal Code (for short referred to as the I.P.C) and sentenced to suffer imprisonment for life and to pay fine of Rs.5,000/- in default of which to suffer simple imprisonment for 2 years for the aforesaid offence.

(3.) On the basis of the aforesaid written complaint (exhibit 1) Hogolberia P.S Case No. 23 of 2004 dated 20/3/2004 under section 302 of the I.P.C was initiated against the accused. Investigation into the case culminated in the submission of the charge-sheet under Section 302 of the I.P.C against the accused/appellant.
