JUDGEMENT

(1.) This second appeal is directed against the judgment and decree dated 24th Jan., 1992 passed by the learned Assistant District Judge, Arambagh in Title Appeal No. 47 of 1989 reversing the judgment and decree dated 8th Feb., 1989 passed by the learned Munsif, 2nd Court at Arambagh in Title Suit No. 59 of 1985.

(2.) The appellant in this appeal was the plaintiff in a suit for declaration and injunction.

(3.) The plaintiff/appellant filed a suit for declaration of his right, title and interest in respect of 'Ka' and 'Kha' schedule property and for permanent injunction for restraining the defendant/respondent from disturbing his peaceful possession in respect of the suit property.
