JUDGEMENT

(1.) This appeal is directed against a Judgment and Order dated 19.6.98 passed by a learned Judge of the Writ Court and dismissing thereby a writ petition, being Writ Petition No. 28827 (W) of 1997. The subject matter of the writ petition was an order dated 13.11.97 by which the Director of School Education, West Bengal held that the Writ petitioner, who is the appellant before us is not eligible for the post of Work Education in terms of Government Order No. 69-End. (S) dated 01.02.84. According to the Director a person who has obtained the degree or diploma from a non-recognised institution is not eligible for the post Work Education in terms of Government Order dated 01.02.84. The learned Judge, in His Lordship's Judgment and Order under appeal, held that His Lordship did not 'feel inspired' to find any infirmity in the order of the Director and the writ petition was dismissed.

(2.) The material facts of the case are that after graduation, the petitioner got admitted in Post Graduate Basic Training Course for the session 1992-1993 in the Minority Post Graduate Basic Training College, Sarisha, District-South 24 Parganas.

(3.) The post of an Assistant Teacher in Work Education fell vacant in Mohirampur High School (hereinafter called the said school) and names were invited from Employment Exchange in terms of prior permission granted to that effect by memo dated 21.01.95 by the District Inspector of Schools (S.E.). The Employment Exchange could not sponsor any name and then with the permission of the District Inspector of Schools advertisements were published in the daily newspaper.
