JUDGEMENT

(1.) This application under Sec. 115 of the Code of Civil Procedure is directed against an order dated 29th Sept. 2004 passed by the learned Civil Judge (Junior Division), 4th Court at Alipore in Title Suit No. 116 of 2001.

(2.) The defendant in a proceeding under Sec. 6 of the Specific Relief Act, is the petitioner before this Court.

(3.) By the order impugned, the defendant/petitioner was directed to restore the possession of the suit property to the plaintiff/opposite party by demolishing the brick built wall constructed inside the collapsible gate of the suit property within 60 days from the date of the order failing which the plaintiff/opposite party was given liberty to put the decree into execution.
