SANKARGOPE Vs. STATE AND OTHERS

JUDGEMENT

(1.) The Superintendent. Alipore Central Jail, who had appeared in person on 8th Sept., 1994, had stated that the Petitioner-accused. Sankar Gope had been released from jail on 5th Aug., 1994 at 7.40 p.m. and has also stated the reasons why he could not release the said accused earlier in view of certain orders passed by the Sub-Divisional Judicial Magistrate at Basirhat.

From the "details of cases pending" against the aforesaid accused Sankar Gope. under Trial Registration No. 2586/94, appearing from the official records, brought by the Jail Superintendent, it appears that he (accused Sankar Gope) had been received from Krishnagar District Jail on 7-7-94. The following six cases are stated therein to be pending against him:-

(3.) The said accused appears to have been "shown released" from the cases mentioned in Serial Nos. I and 2 above on 15th July, 1994 and "shown released" from the cases mentioned in Serial Nos. 3, 4 and 5 above on 21st July, 1994. 25th July and 23rd July, 1994 respectively. The accused had been released from the case mentioned in Serial No. 6 above, being Hasnabad P. S. Case NO. 39 dated 3rd May, 1994, at 7. 40 p.m. on 5th Aug., 1994, when he had been finally released from the Jail.
