JUDGEMENT

(1.) Affidavit-of-service filed in Court today be taken on record.

(2.) The petitioner claims pension on account of the death of her late husband, namely, Ramani Mohan Bag, who was an Assistant Teacher of Manuchak Oriented Primary School, Howrah. Her husband retired from service on 31/1/1997 and died on 22/2/2001.

(3.) The petitioner is, therefore, covered under the decisions of the Special Bench of this Court in the case of District Inspector of Schools (S.E.), Kolkata -Vs- Abhijit Baidya reported in 2013 SCC OnLine Cal 13189 and Md. Abdul Ghani - Vs. - The State of West Bengal & Ors being APOT 104 of 2006.
