DHUKU MONDAL Vs. BLOCK LAND AND LAND REFORMS

Decided On June 11, 2014
Dhuku Mondal Appellant
V/S
Block Land And Land Reforms Respondents

JUDGEMENT

(1.) APPLICATION filed by the private respondent no.3 being Case No. OA 3876/12 (LRTT) is fixed for hearing on 25th June, 2014, we refuse to entertain this writ petition.

(2.) THE Learned advocate appearing for the petitioners submits that in view of pendency of the civil suit being Title Suit No. 164 of 2011 before the Learned Civil Judge (Junior Division), Nabadwip, the proceeding before the Learned Tribunal should be stayed as the fate of the tribunal application is dependent upon the fate of the civil suit.

(3.) IT is thus made clear that if the petitioners seek stay of further proceeding of the tribunal application before the Learned Tribunal, the Learned Tribunal may consider the same on its own merit without being influenced by the order of dismissal of this writ petition by this Court. The writ petition is, thus, disposed of.
