SOUMYAJIT SENGUPTA Vs. STATE OF WEST BENGAL

JUDGEMENT

(1.) THIS is a case where the father of the petitioner was a Clerk -cum -typist attached to the Santaldih Thermal Power High School (H.S), Purulia. During his tenure of his service, he passed away and the present petitioner shortly thereafter approached the appropriate authority for enlistment of his name under died -in -harness category for his employment in the said school. It is also the case of the writ petitioner that the District Inspector of Schools(SE), District Purulia the respondent no. 3 duly forwarded his claim to the Director of School Education, West Bengal, respondent no. 2, for inclusion of his name in the live register for appointment under died -inharness category.

(2.) HAVING received such recommendation, the respondent no. 2 directed the respondent no. 3 to furnish the financial certificate and the certificate as regards to the family income from other sources of the deceased family. However, although such order was passed in 2006 but till the date of moving of the writ application no step was taken by the respondent no. 3 although all relevant papers were submitted to him by the writ petitioner.

IT is further contended by an order passed on July 27, 2011, a co -ordinate Bench of this court directed the Director of School Education, West Bengal, the respondent no. 2 to consider the representation of the writ petitioner and dispose of the same by passing a reasoned order and to communicate the same to him.
