JUDGEMENT

(1.) BY this petition the petitioners have, inter alia, prayed for a writ in the nature of mandamus commanding the respondents to withdraw and cancel the notification issued under Section 4 of the Land Acquisition Act, 1894 (the Act, for short) and the declaration under Section 6 of the Act which have been annexed to the writ petition as Annexures P -3 and P -6 respectively as well as a writ in the nature of madamus commanding the respondents to de -requisition the concerned premises and to deliver peaceful possession thereof and to cancel the Award under Section 11 of the Act.

(2.) THE case of the petitioners, inter alia, is that they are the owners of premises No. 3 Abdul Rasul Avenue, Kolkata. The petitioners Nos. 1 and 2 are the widow and son respectively of late Amitabha Mukherjee.

(3.) TWENTY -five years thereafter, a notification was published under Section 4 of the Act proposing to acquire the said premises. The purpose disclosed in the notification was permanent office accommodation of the Public Works Department (P.W.D., for short), Government of West Bengal within the Police Station of Tollygongue.
