NEW INDIA ASSURANCE CO LTD Vs. KANIKA MAJI

JUDGEMENT

(1.) THIS is an appeal against judgment and award dated May 3, 2008 passed by the learned Additional District Judge, Fast Track, Court No.1, District Burdwan, in Motor Accident Claim Case No.56/58/2006. The victim was run over by the offending vehicle on November 12, 2005 and he died at Dhaniakhali Hospital.

(2.) THE heirs and legal representatives of the victim lodged the claim case contending that from agricultural income the victim used to earn Rs.8,000/ - (Rupees eight thousand) only per month. The victim was 36 years of old as on the date of the accident.

(3.) THE insurance company only contested the claim case.
