GANGADHAR MAHATO Vs. STATE OF WEST BENGAL

JUDGEMENT

(1.) HAVING regard to the facts, as it transpires from the office report dated January 14, 2010, and the contents thereof, the sole appellant Gangadhar Mahato has passed away on September 22, 2008, this appeal stands abated. Now coming to the sentence part it is found that along with sentence of substantive imprisonment the appellant was also sentenced to pay a fine of Rs.500/ -. Since no leave has been obtained to continue with the appeal by the near relatives of the appellant, the fine amount is to be realised in accordance with law and the trial court is directed to take steps in this regard.

(2.) THIS appeal accordingly stands disposed of with the order as indicated above.
