JUDGEMENT

(1.) THE petitioner, Rejaul Ali has challenged in the instant writ petition, show cause notice dated May 21, 1991 (Annexure 'c' to the writ petition) issued by the Commandant, Headquarters 71 Battalion, Border Security Force, Parua Camp, Tejpur, Assam.

(2.) BY the said notice, the Commendation of the view that because of the absence of the petitioner, he tentatively proposed to terminate the service by way of dismissal.

(3.) AT this stage of issuance of show cause notice, when the writ petition was moved before this Court, M. R. Mullick, J, on October 9, 1991, had directed that the matter will appear after the long Puja Vacation after completion affidavits.
