JUDGEMENT

(1.) THE petitioner was a civilian employed in defense service and at the material time was acting as Charge-Electrician, Power House No. 1, at panagarh base.

(2.) FOR loss of government property, namely, empty jerry cans and empty barrels of petrol and lubricants, there was an enquiry conducted by a Staff court of Enquiry, in the year 1955, and ultimately the enquiry was taken up by the Special Police Establishment. The petitioner, who was suspected of being involved in the loss, was suspended, on January 7, 1959, by the respondent Works Engineer, pending the enquiry.

(3.) ON April 22, 1960, the petitioner was charged with misconduct under the following heads of charges:-
