JUDGEMENT

(1.) The Petitioner is an Assistant Professor at Jadavpur University in Linguistics.

(2.) A Complaint, dated August 25, 2021, was formally lodged against the Petitioner alleging sexual harassment at workplace by a student of the University.

(3.) An Internal Complaints Committee (hereinafter referred to as "the ICC") was formed by the University to enquire into the allegations. The committee on March 10, 2022, submitted its report before the Vice-Chancellor of the University. The Petitioner, on April 6, 2022, preferred an appeal before the Executive Council of the University under Rule 8(5) of the University Grants Commission (Prevention, Prohibition and Redressal of Sexual Harassment of Women Employees and Students in Higher Educational Institutions) Regulations, 2015 (hereinafter referred to as "UGC Regulations, 2015).
