JUDGEMENT

(1.) THIS appeal arose out of the judgment and order dated 21.12.2000 and 22.12.2000 passed by the learned Additional Sessions Judge, Hooghly, in Sessions Trial No. 24 of 1999. The fact leading to this appeal is as follows :

(2.) THE prosecution case is that one Takmina Bibi was married with one Ruhul Mallick of village Bhuimahal sometime in 1401 B.S. according to Mohammedan Rites and Customs. A daughter was born out of their wedlock.

(3.) THEREAFTER , the husband of the lady required a sum of Rs. 3,000/ - by mortgaging his land. The father of the victim expressed his inability to pay the amount. The accused persons started physical torture. Even on persuasion they did not desist. On 22.4.1996 all the accused persons again assaulted Takmina for the said sum but it could not be paid.
