JUDGEMENT

(1.) THIS is an Appeal from the Judgment and order of conviction dated 24th August, 2006 passed by the learned Additional Sessions Judge, 2 nd Court, Purulia in Sessions Trial No. 37 of 2006. arising out of Sessions Case No.144 of 2006. By the said order dated 24th August 2006 the appellant was sentenced to suffer rigorous imprisonment for 3 years under Section 498A I.P.C. He was also sentenced to suffer rigorous imprisonment for life under Section 302 I.P.C.

(2.) THE case of the Prosecution was that due to cruelty meted out to the victim by the accused the victim died and a case under Sections 498A and 302 I.P.C. was initiated. The said incident occurred on 2nd September 2004 and the FIR was lodged on 4th September 2004. The FIR was registered as FIR No.28 of 2004 with the Kenda Police Station and investigation initiated. After completion of investigation a Chargesheet was filed.

(3.) CHARGES under Sections 498A and 302 I.P.C. was framed against the accused/appellant which was read over and explained to him to which he pleaded not guilty and claimed to be tried.
