JUDGEMENT

(1.) THIS appeal has been preferred from the order dated 3rd November, 2011 passed by a Learend Judge of this Court whereby and whereunder the said Learned Judge refused to grant any relief to the writ petitioners and dismissed the writ petition accordingly. The writ petitioners thereafter preferred the instant appeal.

(2.) FROM the records we find that the appellants were engaged in different posts under District TB Control Society, Medinipur in terms of the contract executed between the said District TB Control Society and the individual writ petitioners. The aforesaid contract was initially for a period of six months and the same was renewed from time to time till 2005. Thereafter upon considering the performance of the writ petitioners, the competent authority of the said society refused to renew the contract with the writ petitioners and the writ petitioners are, therefore, not discharging any duties since 2006.

(3.) THE appellants herein were not engaged against a permanent post for discharging any duty either by the State Government or any other authorities of the State Government.
