JUDGEMENT

(1.) This writ application is directed against an order No. F. No. S.45-82/2007 Estt, dated 8th July, 2008 passed by the Joint Commissioner of Customs (CHA), Custom House, Kolkata whereby the application of the petitioner for Customs House Agents licence has been rejected on the ground that the petitioner had not passed the examination under Regulation 8 of the Customs House Agents Licensing Regulations, 2004 hereinafter referred to as "CHALR, 2004'.

(2.) The petitioner claims to be carrying on business under the name and style of M/s. R.J. Clearing and Forwarding Agent, which is a sole proprietor concern of the petitioner.

(3.) It is not in dispute that the petitioner has passed the examination under Regulation 9 of the Customs House Agents Licensing Regulation, 1984.
