JUDGEMENT

(1.) IN this application, the appellants/applicants have prayed for condonation of delay in filing this appeal. The last date for filing this appeal expired on 08.07.2010. The instant appeal was filed on 07.09.2011. Thus, there was 426 days delay in filing this appeal before this Court.

(2.) THE reasons for the delay have been explained by the applicants in this application. It is stated therein that the claimants/appellants have lost only bread earner of their family. It is further alleged therein that the appeal could not be filed by them for want of money.

(3.) THE application for condonation of delay being CAN 11748 of 2012 is thus disposed of. Immediately after disposal of the application for condonation of delay filed by the claimants/appellants, we were requested by the learned advocates of both the parties for disposal of the appeal itself on merit after hearing them. Accordingly, the appeal itself is taken up for hearing.
