JUDGEMENT

(1.) THIS application is at the instance of a Lecturer in Computer Science & Engineering Department of Durgapur Institute of Advanced Technology & Management (hereinafter referred to as 'DIAT&M'), Dist. Burdwan and is filed for issuance of writs in the nature of mandamus commanding the respondents to grant the benefits of the Sixth Pay Commission to the petitioner and other consequential reliefs.

(2.) THE case of the petitioner in short is that she was appointed Lecturer in Computer Science & Engineering Department on probation for one year and her basic pay was fixed at Rs.8,550.00 in the pay scale of Rs.8,000-275-13,500 along with other terms and conditions. The petitioner accepted the terms accordingly on August 21, 2009 and her basic pay was re-fixed to Rs.8,825.00 w.e.f. August 1, 2010 on confirmation of service.

(3.) THE respondents are contesting the said application. Now, the question is whether the writs of mandamus as prayed for can be granted in favour of the petitioner.
