RIGHTECH POWER Vs. UNION OF INDIA

JUDGEMENT

(1.) OIL and Natural Gas Corporation Limited, respondent no. 2 (hereafter the O.N.G.C.) by notice dated June 21, 2011 invited seal tenders under two bid system from experienced Indian bidders for hiring of O & M Services for B.I. 2001-I Rig as per the scope of work, special conditions of contract and proforma price schedule in terms of the annexures appended thereto.

(2.) THE petitioner was one of the intending bidders. It is aggrieved because O.N.G.C. has rejected its bid on the ground of its ineligibility to participate in the tender process.

(3.) MR . Bhattacharya, learned senior counsel appearing for the petitioner contended that not only was the petitioner declared ineligible overlooking the fact that it fulfilled all the necessary qualifications stipulated by the tender notice, the ninth respondent ought not to have been selected, for, it had indulged in acts expressly prohibited by such notice.
