(1.) ALTHOUGH the matter is appearing under the heading 'for orders', by consent of the learned advocates appearing for the parties, we take up the hearing of the appeal. All formalities are dispensed with.
(2.) WE have considered the submissions of Mr. Aswini Kumar Bera, learned advocate appearing for the appellant and Mr. Golam Mostaffa, learned advocate appearing for the applicants in the application for succession certificate in the trial court, that is, the respondent nos.1, 2, 3 and 4 in this appeal.
(3.) ONE Jagadananda Ghara had certain deposits with Maratala Post Office. The applicants in the application of succession certificate contended that Jagadananda Ghara died intestate on November 29, 2004 leaving behind him his three sons and two daughters. His wife had predeceased him. Therefore, his sons and daughters would inherit one-fifth share each in the debts and securities left by the said Jagadananda Ghara.
