JUDGEMENT

(1.) THIS application is at the instance of a teacher of the respondent school and is filed for enhancement of pay on increase of qualification in the relevant subject. The petitioner is an Assistant Teacher having the qualification of B.Sc. Honours in Geography and she prayed before the Managing Committee of the respondent school for appearance in the M.Sc. Part-II Geography Examination contending, inter alia, that she was a regular teacher of the relevant subject. Thereafter, she completed her Post Graduate Degree, but the respondents did not enhance her pay according to the Post Graduate scale. So, this application has been preferred.

HAVING heard the learned Advocate for the petitioner and on perusal of the materials on record, I find that though the petitioner has claimed that she was granted permission by the Managing Committee to appear at the Post Graduate Degree in the relevant subject from the University of Kalyani, the papers furnished by her do not indicate that the District Inspector of Schools (SE), Nadia gave her permission to appear in the said examination. The only paper, the petitioner has shown relating to such permission by the Managing Committee of the concerned school, is Annexure P-2 at page no.26 of the writ petition. The Managing Committee had indicated that the Headmaster would submit the application and other papers before the Additional District Inspector of Schools (SE), Ranaghat to do the needful. Though, the petitioner has been able to file the papers relating to approval of the study leave, there is no paper that the School Authority had sent any papers to the concerned Additional District Inspector of Schools (SE) relating to the permission by the Additional District Inspector of Schools (SE). Nor is there any paper to show that the District Inspector of Schools (SE), Nadia granted her permission to appear at the M.Sc. Part II Examination in Geography.

(3.) CONSIDERING the circumstances, there will be no order as to costs. Urgent xerox certified copy of this order, if applied for, be supplied to the learned Advocates for the parties on their usual undertaking.
