JUDGEMENT

(1.) THIS appeal arises out of judgment dated 16.08.2010 passed by learned Judge of the Motor Accidents Claim Tribunal, Islampur, Uttar Dinajpur in M.A.C. case No. 89 of 2008.

(2.) THE fact of the case made out by the appellants/claimants before the Tribunal, in brief, is that one Johan Tappa @ Johan Tappo died of motor accident on 15.08.2008. He was aged about 50 years at the time of his death and was earning about Rs. 3,000/ - per month as Labourer of the tea garden. The appellants, being the legal representatives of the deceased Johan Tappa @ Johan Tappo claimed compensation of Rs. 2,00,000/ - by impleading the owner of the offending vehicle and the Respondent -Insurance Company as opposite parties before the Tribunal.

(3.) ON consideration of the evidence adduced by the respective parties, the Tribunal awarded compensation of Rs. 1,19,500/ -. Being aggrieved by the decision of the Tribunal, the appellants have preferred this appeal for enhancement of the amount of compensation.
