JUDGEMENT

(1.) This writ petition is directed against the alleged refusal of the respondent authorities to clear goods unloaded at the Kolkata Port, shipped from Singapore under Bill of Lading No. CCUCTB 754, dated 10th August, 2012, for onward journey to Nepal.

(2.) The petitioner claims to be a citizen of Nepal, carrying on business under the name and style of Pradeep and Company. The petitioner claims to be the sole proprietor of Pradeep and Company.

(3.) According to the petitioner, the petitioner is engaged in the business of import and export at Nepal. However, Nepal being a land-locked country and by reason of the existing treaty of transit between Union of India and Government of Nepal, Union of India has been providing corridor to the goods imported into Nepal through sea.
