(1.) :- By this petition order of reversion dated 9th July, 1990 and consequent thereupon an order dated 24th March, 1994 are challenged. The short fact of the case is that the petitioner was appointed Development Officer of Life Insurance Corporation of India (hereinafter referred to as Corporation) on or about 1st Sept., 1956. Under the regulations of the Corporation the respondent No. 6 herein, as such Development Officer was not a paid employee. However, he earned a commission on the basis of the business procured by him for the respondent No. 6, but officials in the cadre of Assistant Branch Manager is appointed from this field.

On 19th Sept., 1975 the petitioner was appointed to the post of Assistant Branch Manager, according to the petitioner, by the respondents, on being satisfied with the performance of the petitioner in the capacity of Development Officer. On 1st Aug., 1981 disciplinary order was passed reverting the petitioner to the post of Development Officer from Assistant Branch Manager. The petitioner challenged this order by filing a writ petition in this Court, being C.O. No. 9353 (W) of 1983.

Late Justice Mohitosh Majumdar (as His Lordship then was) by an Order dated 25th Aug., 1987 was pleased to set aside the order of reversion and directed the respondent authorities to reinstate the petitioner to the post of. Assistant Branch Manger with retrospective effect from 19th March, 1976. By this order His Lordship was pleased to give liberty to the respondent to proceed afresh in accordance with law and giving opportunity of being heard to the petitioner.
