JUDGEMENT

(1.) This second appeal is at the instance of the plaintiffs and is directed against the judgment and decree dated January 8, 2004 passed by the learned Civil Judge (Senior Division), Ghatal in Title Appeal No.13 of 2000 thereby reversing the judgment and decree dated April 24, 2000 passed by the learned Civil Judge (Junior Division), Ghatal in Other Suit No.117 of 1996.

(2.) The plaintiffs/appellants instituted a suit for eviction, recovery of possession, mesne profits against the defendant/respondent in respect of the premises in suit as described in the schedule of the plaint on the ground of default, reasonable requirement, nuisance, etc. before the learned Civil Judge (Junior Division), Ghatal.

(3.) The defendant/respondent contested the said suit by filing a written statement denying the material allegations raised in the plaint.
