JUDGEMENT

(1.) During the course of submissions, Mr. Anil Kumar Gupta, learned Counsel appearing for the UGC, produced, for the perusal of this Court, two Letters signed by one Uma Bali, Under Secretary of the UGC dated 11.4.2011 and July 2011. In the first Letter dated 11.4.2011, it has been mentioned that the Government of India, Ministry of HRD, on the advise of the UGC, had granted the Deemed University status to the Rastriya Sanskrit Sansthan vide Notification dated 7.5.2002 comprising of 8 (eight) Multi Campuses located at Allahabad, Garli (HP), Jaipur, Jammu, Lucknow, Puri, Sringeri and Trichur.

It has further been stated that the UGC had allowed the said Sansthan to continue to affiliate only those traditional Sanskrit Colleges which were affiliated to it prior to the conferment of the Deemed University status subject to the condition that the Sasnsthan would follow UGC guidelines for affiliating the colleges and that the Sansthan would also try to disaffiliate those colleges in a phased manner. The text of this letter has also been brought on record by the added Respondent No. 5 as Annexure "R-5" in its Affidavit-in-opposition dated 17.9.2011.

However, upon a perusal of the aforesaid Letter dated 11.4.2011, it is evident that the Commission, in its 427th meeting held on 7.4.2006 considered the proposal for affiliation of traditional Sanskrit Colleges with the Rastriya Sanskrit Sansthan (Deemed University) and it is stated as follows :
