JUDGEMENT

(1.) THE judgment of the Court was as follows: -

(2.) IT is directed against the order dated 22nd July, 2011 passed by the learned Judicial Magistrate, 2nd Court, Barrackpore, North 24-Parganas in M. Case No. 40 of 2009 rejecting the prayer of the petitioners for maintenance as per the provision of Section 125 of the Code of Criminal Procedure.

(3.) AS against this, O.P No. 2 contested the said proceeding by filing written objection wherein the allegations made by the petitioners had been denied. It is specifically stated in that written objection that the petitioners were not entitled to get any maintenance from their widow daughter-in-law as per the provision of Section 125 of the Cr. P.C. Dismissal of the application under Section 125 Cr. P.C, had been so prayed for.
