(2.) None has appeared on behalf of the opposite party. The matter was fixed also yesterday but none appeared on behalf of the opposite party. Under the circumstances, the application is taken up for hearing.

(3.) This application is at the instance of the petitioner and is directed against the Order no. 17 dated 25.08.2011 passed by the learned Judge, 5th Bench, City Civil Court at Calcutta in Misc. Case No. 368 of 2011 arising out of the Title Suit no. 264 of 2011.
