JUDGEMENT

(1.) Writ petitioner was an employee of Eastern Coalfields Limited at its (hoodia Colliery in the district of Dhanbad outside the State of West Bengal. He was issued a letter of superannuation dated 27th March, 1999 asking him to retire with effect from 17th Aug., 1999 as he would attend the age of 60 years on the said date as per the service records maintained by the said colliery. The petitioner raised age dispute and according to him his date of birth was 21st Aug., 1951 and not 17th Aug., 1939 as recorded in the records of the respondent authority. The petitioner was examined by the medical board who had rejected the plea of the petitioner. Hence, this petition.

(2.) A preliminary objection was raised by the respondent to the effect that this Court had no territorial jurisdiction to entertain this writ petition.
