JUDGEMENT

(1.) This revisional application is directed against the Order No. 88 dated Feb. 26, 1998 passed by the learned Addl. Civil Judge (Junior Division), Serampore in Title Suit No. 98 of 1997 in the file of the said Court.

(2.) By the impugned order the Court below allowed the plaintiff/opposite party's application under Sec. 17(3) of the West Bengal Premises Tenancy Act, 1956 (the '1956 Act' for short) striking out the defence of the defendant against delivery of possession of the suit premises.

(3.) The above order was passed following the direction of this Court in a revisional application filed earlier against the order of the learned Munsif of the self-same Court allowing the plaintiff's application under Sec. 17(3) of the 1956 Act.
