JUDGEMENT

(1.) Although, the matter is appearing under the heading 'for orders', we take up this matter for hearing by consent of the learned Advocates appearing for the parties.

(2.) This is an appeal against ex parte judgment and decree dated June 30, 2008 passed by the learned Judge, Eighth Bench, City Civil Court, Calcutta, in Title Suit No. 1517 of 2001.

(3.) It is a suit for declaration, in substance, that the Plaintiff was a thika tenant in relation to the property-in-suit.
