JUDGEMENT

(1.) THE two writ petitions are taken up for consideration together since the issues involved are identical.

(2.) THE writ petitioner in W.P. No. 1241 of 2009 is an honours graduate in Political Science and holds a post-graduate degree in 'International Relations'. He also successfully completed the National Eligibility Test (hereinafter referred to as NET) conducted by the University Grants Commission (hereinafter referred to as UGC).

(3.) ALL the petitioners applied for the post of Lecturers in Political Science in terms of advertisement No. 03/2008 dated 5th December, 2008, issued by the Secretary, West Bengal College Service Commission. Consequently, they participated in the selection process. A provisional merit list was published on 25th November, 2009, in which their total grades or marks were evaluated without taking into consideration their NET qualification. The writ petitioners, being aggrieved by the decision of the West Bengal College Service Commission of not awarding seven marks to them on the basis of their NET qualification, chose to file these two writ petitions.
