SAILENDRA NATH SARKAR Vs. STATE OF WEST BENGAL

JUDGEMENT

(1.) This appeal is directed against a judgment and order dated 7th May 1987 passed by the learned Additional Sessions Judge, Coochbihar in Sessions Case No. 34 of 1979 corresponding to Sessions Trial No. 1(6) of 1980 by which the Appellants Sailendra Nath Sarkar, Khakuri Sarkar and Jatindra Nath Barman were convicted of an offence under Section 302 read with Section 34 IPC and were sentenced to suffer rigorous imprisonment for life.

(3.) Since the Appellants remained unrepresented Mr. Jyotirmoy Adhikary was appointed amicus curiae to represent them. It has already come on the record that the Appellant Jatin died on 23rd February 1999. By the order dated 5th February 2003 it was recorded that the appeal preferred by the said Jatin the Appellant No. 2 abetted.
