JUDGEMENT

(1.) In this Writ Petition, the Petitioner prays, inter alia, for an Order commanding upon the Authorities to declare his post publication scrutiny results of Chemistry-1 of the 2nd Semester Examinations and to issue a fresh mark-sheet of the 1st Semester and 2nd Semester Examinations after holding the practical examination in Workshop Practice Laboratory of the 1st Semester. He has also prayed for an appropriate Order directing the Respondent No. 3 (Principal, B. P. Poddar Institute of Management and Technology) to allow him to attend regular classes of the 3rd Semester as a qualified candidate.

(2.) The case of the Petitioner is that having qualified in the West Bengal Joint Entrance Examinations in the year 2010, he was admitted in the B. P. Poddar Institute of Management and Technology in the B. Tech course in the stream of Computer Science Engineering. He appeared in the 1st Semester examinations held in November 2011 but when the results were published, he noticed that his semester grade point average was 4.04 and he had failed in four subjects including Workshop Practice Laboratory.

According to the Petitioner, and as has been stated in Para-6 of the Writ Petition, he was suffering from acute Gastroenteritis from the month of November 2010 and therefore he was unable to appear in the final 1st Semester Exams on 25.11.2010 in the Workshop Practical Laboratory Papers. His father communicated this fact to the Principal along with a letter dated 25.11.2010 which was accompanied by a Medical Certificate (Annexure-P/3, pages 23 and 24).
