JUDGEMENT

(1.) The petitioner is seeking for bail in connection with a case relating to the offence punishable under sections 493/ 376/ 323/ 325/109 of the Indian Penal Code.

(2.) It is submitted that the petitioner is in custody for 139 days and already investigation is over and the charge sheet has been submitted. We have gone through the case diary and more particularly the statements of the victim recorded under section 164 of the Code of Criminal Procedure. Going through the same, it appears that this is a case where the petitioner cohabited with the victim on a promise to marry her and then declined.

(3.) Considering the nature of allegations and the petitioner s period of detention in the custody, we do not think that the petitioner s further detention is necessary.
