JUDGEMENT

(1.) This application is, in effect, in the nature of review of the order dated 24th July, 2000 passed by this Court under which the original order dated 17th June, 1999 being Annexure 'D' to the application similarly placed with other two matters passed on 18th May, 2000 stand recalled.

(2.) Originally when the application for appointment of arbitrator was pending before this Court, the parties have agreed to accept the appointment of departmental nominee as arbitrator. Therefore, such application was dismissed for non-prosecution.

(3.) On 24th July, 2000 such order was recalled and replaced by an order passed in other matters and Court held that the appointment of arbitrator will be made in this case with the intervention of the Court. Accordingly, the matter was referred to the the Honourable Chief Justice for the purpose of filling up the post of arbitrator.
